USTR Extends Some Expiring China 301 Exclusions until May 31, 2025; Allows the Balance to Expire on June 14, 2024 - GDLSK (2024)

In a notice made available on May 24, 2024, the USTR announced the fate of the 429 product-specific China 301 exclusions (352 previously reinstated exclusions and 77 COVID-related exclusions) which were scheduled to expire on May 31, 2024. Based on public comments received, the USTR determined to extend 164 of the exclusions through May 31, 2025. The remaining 265 exclusions will expire after a 14-day transition period extending through June 14, 2024.

With respect to the exclusions that will be extended until May 31, 2025, the USTR found that their extension will support efforts to shift sourcing out of China, or provide additional time to find alternate sources of supply where availability of the product outside of China remains limited.

With respect to the exclusions being allowed to expire (after June 14, 2024), the USTR considered such factors as:

  • No comments submitted.
  • Comments indicating that importers had no plans to shift sourcing out of China in 2024 (or at all).
  • Commenters reporting that importers had taken few or no steps to shift sourcing out of China.
  • Comments indicating availability from domestic or third country sources.
  • Claims of unavailability based on China pricing.
  • Comments failing to explain efforts undertaken or how further extending the exclusion would aid efforts to shift sourcing.

A list of those exclusions being extended with respect to goods entered no later than May 31, 2025 appears below. The remaining existing exclusions are only extended with respect to goods entered no later than June 14, 2024. The full lists are available in the USTR notice.
